Even with the rigorous investigative processes in place, the issue of passing on the harasser has been a unique hurdle for Universities. In the past faculty and others have been allowed to quietly resign in response to allegations or at times NDAs have disallowed the sharing of information related to investigations. Substantial findings of misconduct may not appear in criminal background checks or openly shared by references. In response to these issues, several Universities have begun to develop polices and procedures for enhanced candidate screening.
